1. Seller
The WebnR software is sold by [societe_nom — to fill in Admin › Settings], Entreprise individuelle (micro-entreprise), whose registered office is located at [societe_adresse — to fill in Admin › Settings], registered under SIRET number [societe_siret — to fill in Admin › Settings] ([societe_rcs — to fill in Admin › Settings]). Contact: ADMIN_EMAIL.
These terms of sale (the "Terms of Sale") apply to any subscription taken out on https://studio.webn.fr by a customer (the "Customer"). The Customer accepts them by ticking the box provided for this purpose before payment. The accepted version is recorded together with the date of the order.
2. What is sold
The subscription grants the right to use the WebnR Windows application (digital content supplied by download, not on a tangible medium) on one computer at a time, together with its updates, for the entire duration of the subscription.
WebnR operates third-party services that are not included in the subscription and that the Customer subscribes to and pays for directly with their providers: a Claude subscription (Pro or Max) with Anthropic, a ChatGPT subscription (Plus or higher) with OpenAI (or, if the Customer prefers, their own API keys with those providers), as well as Roblox Studio. The Customer signs in to these services directly with their providers: the seller has no access to any of the Customer's credentials, does not resell or pay for the use of these services, and the Customer undertakes to comply with their terms of use. WebnR is not published, endorsed by or affiliated with Anthropic, OpenAI or Roblox Corporation. The Customer must also have a computer running Windows 10 or 11 (64-bit) and a permanent Internet connection.
The main characteristics of the software are presented on the "How it works" and "Pricing" pages of the website. The Customer is invited to read them, and to use the free trial, before subscribing.
3. Price
The subscription price is stated in euros, all taxes included: €4.99 per month for 3 months, then €7.99 per month. VAT not applicable, art. 293 B of the French General Tax Code.
Where a launch offer is available, the reduced price applies for the number of months stated at the time of subscription, after which the standard price applies automatically.
The seller may change its prices. A price change applies to an ongoing subscription only after the Customer has been informed by e-mail at least 30 days before the relevant renewal date; the Customer may then cancel free of charge before that date.
4. Free trial
New Customers are entitled to a free trial of 7 days. The trial is limited to one per person and per computer; the seller may refuse it in the event of repeated use (new account, new e-mail address or same computer).
A payment method is requested at the start of the trial, but nothing is charged during the trial. A reminder e-mail is sent approximately two days before the end of the trial. Unless cancelled before the end of the trial, the paid subscription starts automatically and the first month is charged.
5. Order and payment
To subscribe, the Customer creates an account, confirms their e-mail address, accepts these Terms of Sale, requests immediate access to the software (section 8) and then pays by bank card (via Stripe) or by PayPal. Payment card data is processed solely by these providers and never passes through the seller's servers.
Payment is charged automatically on each monthly renewal date. An invoice is made available in the customer area for each payment.
If a payment fails, access to the software is suspended immediately until payment is made. If payment is still not made after the payment provider's further attempts, the subscription ends.
6. Term and automatic renewal
The subscription is taken out with no minimum commitment, for a period of one month, automatically renewed every month on the same date until the Customer cancels it.
7. Cancellation
The Customer may cancel at any time from their customer area, under "Subscription", using the "Cancel my subscription" button (also accessible via the "Cancel your subscription" link at the bottom of every page of the website). A cancellation confirmation is sent to the Customer by e-mail.
- During the free trial, cancellation takes effect immediately and nothing is charged.
- After the trial, renewal stops: the current month remains due and is not refunded, either in full or pro rata. The Customer retains access to the software until the end of the paid period.
At the end of the subscription, whatever the reason, the licence is deleted and the software can no longer be used. Files created by the Customer (games, scripts, models, images) remain on their computer and belong to them.
The seller may terminate the subscription, after a formal notice that has remained without effect for 8 days, if the Customer breaches these Terms of Sale or the terms of use. In the event of fraud (circumventing the licence, sharing an account, abusively disputed payment), termination may be immediate.
8. No right of withdrawal
In accordance with Article L221-28 13° of the French Consumer Code (Code de la consommation), the right of withdrawal cannot be exercised for the supply of digital content not supplied on a tangible medium where performance has begun with the consumer's prior express consent and express waiver of their right of withdrawal.
When ordering, the Customer expressly requests immediate access to the software and acknowledges that they lose their right of withdrawal as soon as that access begins, by ticking the box provided for this purpose. This consent is confirmed in the subscription confirmation e-mail. Consequently, no refund is due on the basis of withdrawal. The free trial allows the Customer to evaluate the software before any payment.
9. Licence to use
The seller grants the Customer, for the duration of the subscription, a personal, non-exclusive and non-transferable right to use WebnR for their own projects, on only one computer at a time. The Customer may transfer their licence to another computer no more than 3 times per 30-day period.
The software checks the validity of the licence online, continuously; it does not work without an Internet connection and locks when the licence is no longer valid.
It is prohibited to share one's account, to resell, rent or make the software available to others, to circumvent or disable the licence check, and to decompile or modify the software, except in the cases permitted by Article L122-6-1 of the French Intellectual Property Code (Code de la propriété intellectuelle).
10. Updates
Software updates are included in the subscription and are installed automatically. The seller informs the Customer of updates, including security updates, that are necessary to keep the software in conformity, in accordance with Article L224-25-25 of the French Consumer Code (Code de la consommation).
11. Statutory warranties
A Customer who is a consumer benefits from the statutory guarantee of conformity for digital content and services provided for in Articles L224-25-12 et seq. of the French Consumer Code (Code de la consommation), for the entire duration of the subscription. In the event of a lack of conformity, the Customer may have the software brought into conformity or, failing that, obtain a price reduction or termination of the contract, under the conditions set out in those articles. These Terms of Sale do not limit these rights.
12. Liability
WebnR is a creation-assistance tool: content produced by third-party artificial intelligence must be checked by the Customer before any publication. The services of Anthropic, OpenAI and Roblox are provided by those companies under their own terms; the seller is not responsible for their availability, their usage limits or changes to them. If one of these providers changes its terms or services in a way that permanently prevents the use of an essential WebnR feature, the seller will inform Customers by email; the Customer may then cancel their subscription at any time, without prejudice to the legal guarantee of conformity.
The Customer remains responsible for backing up their files; WebnR backs up the Roblox place before each modification, but this does not replace regular backups.
Except in the case of gross negligence or wilful misconduct and except for personal injury, the seller's liability is limited to the amount paid by the Customer over the last twelve months.
13. Personal data
The Customer's data is processed in accordance with the privacy policy.
14. Complaints and mediation
For any complaint, the Customer may write to ADMIN_EMAIL. A response will be provided as soon as possible.
In the event of an unresolved dispute, a Customer who is a consumer may refer the matter free of charge to the following consumer mediator (Articles L612-1 et seq. of the French Consumer Code (Code de la consommation)): [mediateur — to fill in Admin › Settings].
15. Governing law
These Terms of Sale are governed by French law, without depriving a Customer who is a consumer of the more protective mandatory provisions of the law of their country of residence. Failing an amicable settlement, the dispute may be brought before the competent courts, including those of the consumer's place of residence.
16. Changes to the Terms of Sale
The seller may amend these Terms of Sale. The new terms are communicated to the Customer by e-mail at least 30 days before they take effect; a Customer who does not accept them may cancel their subscription before that date.
